Understanding Florida Workers Comp Class Codes
Workers' compensation class codes are four-digit numbers assigned by the National Council on Compensation Insurance (NCCI) to categorize employees based on their job duties and the associated injury risk. Every Florida employer must correctly classify their workers under the appropriate NCCI class code — misclassification can result in policy cancellation, back-owed premium, and fines.
The rate shown for each class code is the base rate per $100 of payroll before any experience modification factor (EMR) is applied. New businesses typically start with an EMR of 1.0. A business with a strong safety record may earn an EMR below 1.0, reducing their premium. A business with frequent claims may have an EMR above 1.0, increasing their premium.
Construction vs. Non-Construction: Florida applies different coverage thresholds depending on whether a business is classified as construction. Construction employers (those with NCCI codes in the construction range) must carry workers' comp with 1 or more employees. Non-construction employers must carry coverage with 4 or more employees.
